The Consequences of Traffic Violations

Unfortunately, there are several potential long-term consequences of traffic violation convictions. To start, you should understand that traffic violations stay on your insurance for up to 39 months and can significantly increase your insurance premiums. They also can result in costly assessments by the DMV, such as the driver responsibility assessment. This is a fee you must pay to DMV over a three-year period if you are convicted of certain traffic offenses in New York State or accumulate 6 or more points on your driving record within 18 months for convictions of traffic offenses committed in New York or the Canadian provinces of Ontario or Quebec.

This fee is in addition to any fines, penalties, or surcharges that you must pay for a traffic conviction. You must pay the driver responsibility assessment whether you have a driver’s license issued by New York State, another state, or even if you do not have a driver’s license. The amount owed for a driver responsibility assessment from the DMV depends on the type of violation(s) or the total number of points on your driving record.

For example, if you are convicted of an alcohol or drug-related traffic offense or if you refuse to take a breath test or chemical test, the annual assessment is $250. The total assessment for the three years is $750.

If you receive 6 points on your driving record for violations committed during a period of 18 months, the annual assessment is $100. The total assessment for the three years is $300. If you receive more than 6 points on your driving record during a period of 18 months, the annual assessment is $25 for each point in addition to the original six points. The total assessment for the three years is $75 for each point in addition to the original 6 points.

If you do not pay the DMV driver responsibility assessment, your driver’s license or learner permit will be suspended. If you do not possess a New York driver’s license, your driving privileges in New York State will be suspended.

Adult drivers will have a suspension hearing at the DMV if they receive between nine and 11 points on their license. If they receive three speeding violations within 18 months, they will lose their license. We can help you get a conditional driver’s license if this happens to you.
